What the Law Says

California Code of Civil Procedure § 377.60 allows certain surviving family members — such as a spouse, domestic partner, or children — to bring a wrongful death claim when a person is killed as the result of another party’s wrongful act or negligence.

Everyone is responsible for injuries caused to others by their want of ordinary care or skill. Passengers injured in a crash — and the families of passengers who are killed — may pursue compensation from any driver or other party whose negligence contributed to the collision.
