What the Law Says

Texas Transportation Code Section 545.053 requires a driver overtaking another vehicle – including a bicycle or e-bike – to pass only to the left and at a safe distance, and not return to the right lane until safely clear. Harris County Precinct 4 has not said whether the driver involved in this crash was passing, turning, or approaching the child head-on, and the investigation is still active. If it is later determined that the driver failed to keep a safe distance from the child on the e-bike, that could support a civil claim for the injuries.

Separately, Texas Transportation Code Section 545.401 makes it a criminal offense to drive a vehicle in wilful or wanton disregard for the safety of persons or property.
