What the Law Says

Texas Transportation Code Section 545.351 requires that a driver never operate a vehicle, including a school bus, at a speed greater than is reasonable and prudent given the road, weather and traffic conditions at the time. Drivers must also reduce speed when approaching curves, intersections or other hazards. Investigators use this standard to evaluate whether a vehicle’s speed contributed to a single-vehicle rollover like the one on Huling Road.

Texas Transportation Code Section 547.701 requires most school buses purchased by a district to be equipped with three-point seat belts for every seat, including the driver’s, unless the district’s board formally votes that the cost is not feasible. Whether the bus involved in this crash was equipped with seat belts, and whether they were in use, is a factual question a full investigation would need to resolve.
