A San Antonio man has been sentenced to 10 years in prison for a 2024 drunk-driving crash that killed his passenger. Jose Luis Ibarra, 25, was convicted of intoxication manslaughter after prosecutors said he was driving 116 mph while intoxicated when he crashed his Dodge Charger into the back of a pickup truck on Historic Old Highway 90. His passenger, Alexandra Jasmine Vargas, suffered burns and broken bones and later died from her injuries at a hospital. A blood test taken after the crash showed Ibarra’s blood-alcohol concentration was 0.166, more than twice the legal limit.

According to KSAT, data pulled from the Charger’s airbag control module showed the accelerator was fully depressed up to half a second before impact and that the vehicle was traveling 116 mph, indicating Ibarra never applied the brakes. Investigators found no skid marks or steering-input markings showing any attempt to avoid the crash, the outlet reported. The collision happened in the 500 block of Historic Old Highway 90 in San Antonio on June 28, 2024. Ibarra was sentenced this week following his conviction, according to KSAT and Hoodline.

What the Law Says

Under Texas Penal Code Section 49.08, a person commits intoxication manslaughter when they operate a motor vehicle while intoxicated and, because of that intoxication, cause the death of another person. The offense is a second-degree felony punishable by 2 to 20 years in prison and a fine of up to $10,000. Courts may also order license suspension and mandatory ignition interlock devices upon conviction.

Texas Transportation Code Section 545.351 requires drivers to operate a vehicle at a speed that is reasonable and prudent under existing conditions and never in excess of posted limits. In DWI fatality cases, prosecutors often point to excessive speed, captured through vehicle data recorders like airbag control modules, as evidence of the reckless disregard that caused the crash. Violating this statute can support both criminal charges and civil liability in a wrongful death claim.
