What the Law Says

Texas Transportation Code § 545.060 requires drivers to stay within a single marked lane and to move out of that lane only when the movement can be made safely. On a multi-lane interstate like I-10, this duty applies to passenger vehicles, motorcyclists, and commercial trucks alike. Because commercial trucks have significant blind spots, unsafe lane changes are a common factor in truck-versus-motorcycle collisions. Investigators typically review dash-cam and event-data-recorder information to determine whether a driver violated this lane-safety rule.

Texas Transportation Code § 545.062 requires drivers to maintain a following distance that allows them to stop safely if the vehicle ahead brakes suddenly, taking speed, traffic, and road conditions into account. This statute is especially relevant in rear-end collisions like the one on I-10, since striking the back of a much larger vehicle such as an 18-wheeler is often catastrophic for a motorcyclist. Speed and following distance are among the first things investigators examine after a rear-end crash involving a motorcycle. A violation of this statute can support a finding of negligence.
