What the Law Says

Texas Transportation Code Section 545.062 requires drivers to maintain a safe following distance behind the vehicle ahead, taking into account speed, traffic conditions, and the condition of the roadway. Rear-end collisions like the one on I-635, where a vehicle struck a semi-truck that had slowed for traffic, are frequently linked to violations of this following-distance rule. Following too closely reduces a driver’s ability to stop safely when traffic ahead slows or stops unexpectedly, particularly at night or in low-visibility conditions.

Texas Transportation Code Section 545.351 requires drivers to operate at a speed that is reasonable and prudent for existing conditions, and never faster than what allows the vehicle to be stopped safely within the assured clear distance ahead. This statute is commonly cited in early-morning highway crashes where reduced visibility, traffic slowdowns, or fatigue may prevent a driver from reacting in time. Investigators often examine whether a driver’s speed was appropriate given the traffic and road conditions at the time of a rear-end crash.
