A woman was killed early Saturday morning when a suspected drunk driver traveling the wrong way slammed into her car on the Eastex Freeway in Houston. The Harris County Sheriff’s Office says a pickup truck driver headed south in the northbound lanes near East Mount Houston Avenue collided head-on with a Honda Accord at about 1:47 a.m. The woman driving the Accord was pronounced dead at the scene. The pickup truck driver was taken to a hospital and was later charged with intoxication manslaughter, according to authorities.

ABC13 Houston reports that the wrong-way driver had allegedly been traveling nearly two miles in the wrong direction before the crash and that his blood alcohol level was reportedly three times the legal limit. HCSO shut down the northbound lanes of the Eastex Freeway for several hours to process the scene, reopening the roadway around 7 a.m. Investigators say toxicology results will be forwarded to a crash reconstructionist and then to the Harris County District Attorney’s Office. Sheriff’s officials noted that wrong-way crashes on Houston freeways are frequently linked to impaired driving.

What the Law Says

Texas Penal Code § 49.04 makes it a crime to operate a motor vehicle in a public place while intoxicated by alcohol, drugs, or a combination of the two. When an intoxicated driver’s conduct causes another person’s death, Texas Penal Code § 49.08 allows prosecutors to charge intoxication manslaughter, a second-degree felony punishable by up to 20 years in prison. The statute does not require proof of recklessness beyond the fact that the driver was intoxicated and caused a fatal crash. Authorities say the wrong-way driver’s blood alcohol level was reportedly several times the legal limit, and toxicology results will help determine what charges are ultimately pursued.
