A Fort Bliss soldier was arrested and charged with collision involving death nearly seven months after a hit-and-run crash killed 37-year-old Erica Suann Garcia in far East El Paso. Garcia was struck at about 2:09 a.m. on February 8, 2026, while crossing Tim Foster Street outside a marked crosswalk near Pebble Hills High School, according to investigators. She was taken to a hospital, where she later died from her injuries. Authorities say the driver, 20-year-old Harmony Adynasty McNair, allegedly left the scene without waiting for police or rendering aid.

According to KFOX14, a preliminary investigation found that McNair’s southbound 2025 Kia K4 struck Garcia as she crossed outside a crosswalk or controlled intersection, and a witness reported seeing the vehicle spin out just before the crash. An El Paso County grand jury indicted McNair on one count of collision involving death on July 22, and a warrant was issued July 30. Hoodline reported that McNair, a fire control specialist assigned to the 1st Armored Division, was arrested on September 11 after transferring to Fort Knox, Kentucky for training, and was booked into the El Paso County Jail on a bond that was reduced to $20,000. As of the most recent reporting, McNair remained in custody and the case remained pending, with her defense disputing whether she rendered aid at the scene.

What the Law Says

Texas Transportation Code 550.021 requires the driver of a vehicle involved in a crash that results or is reasonably likely to result in injury or death to immediately stop at the scene, determine whether anyone needs aid, and remain until police requirements are satisfied. A violation is a second-degree felony when the collision caused a death. This statute is central to the charge McNair allegedly faces, since investigators say she left the scene of Garcia’s fatal injuries without rendering aid or waiting for authorities.

Texas Transportation Code 552.005 states that a pedestrian crossing a roadway at a point other than a marked or unmarked crosswalk must yield the right-of-way to vehicles, which investigators note applies to how Garcia was crossing Tim Foster Street. Even so, Texas law does not excuse a driver from the separate duty to stop and render aid after striking a pedestrian, and a pedestrian’s failure to use a crosswalk does not eliminate a driver’s potential liability for fleeing the scene.
