Five teenagers were injured, two of them seriously, when an off-road vehicle rolled over multiple times in far East El Paso County over the weekend. Authorities say the 20-year-old driver was intoxicated behind the wheel of the off-highway vehicle when he lost control while traveling westbound near the intersection of Ponchatula and Mandeville. All five juvenile passengers, ages 15 to 16, were taken to area hospitals for treatment. The driver now faces felony charges in connection with the crash.

According to Hoodline, the crash happened Saturday, August 29, around 12:15 p.m., when the off-road vehicle carrying the five teens rolled several times in the 14900 block of Mandeville Avenue. The outlet reported that the driver, identified as Jorge Alberto Gomez Alvarez, 20, was arrested and charged with two counts of intoxication assault with a vehicle after investigators determined he was intoxicated at the time of the crash. He was booked into the El Paso County Detention Facility on a $10,000 bond. The El Paso County Sheriff’s Office said its Special Traffic Investigators are handling the case.

Texas Penal Code Section 49.07 makes it a felony to cause serious bodily injury to another person while operating a vehicle intoxicated. Because two of the injured teens suffered serious injuries, the driver here faces intoxication assault charges, typically a third-degree felony carrying significant prison exposure and a lengthy license suspension. A criminal charge does not resolve civil liability; injured passengers and their families can pursue a separate personal injury claim against the intoxicated driver regardless of the outcome of the criminal case.

Texas Transportation Code Chapter 663 governs off-highway vehicles like the one involved in this crash, including where they may legally be operated and the precautions required when minors are aboard. Off-highway vehicles generally are not built for use on public roads and lack the safety features of standard passenger vehicles, which is part of why rollovers like this one so often lead to serious injury. When an off-road vehicle is driven on a public roadway and causes a crash, the operator can be held liable under this statute in addition to ordinary negligence law.
