A wrong-way crash on U.S. Highway 67 near Danieldale Road in Duncanville, Texas, left one person dead late Thursday night. Authorities say a vehicle was traveling north in the southbound lanes when it struck an oncoming car and then clipped several other vehicles before coming to a stop. Firefighters had to extract one victim from the wreckage; that person was pronounced dead at the scene. What the Law Says

Texas Transportation Code Section 545.051 requires drivers to stay on the right-hand side of the roadway and prohibits driving against the flow of traffic on a divided highway. When a driver enters oncoming lanes, as authorities say happened in this Highway 67 crash, the resulting head-on impact is typically strong evidence of a traffic violation in a civil injury claim. Wrong-way collisions on divided highways are especially dangerous because of the high combined closing speed of the vehicles involved.

Because the crash left one person dead, the case may also fall under the Texas Wrongful Death Act, Civil Practice and Remedies Code Section 71.002, which lets a spouse, child, or parent of the deceased bring a claim against the at-fault driver. Texas follows a modified comparative fault rule, so any recovery can be reduced if the deceased is found partly at fault, but a family is generally not barred from recovering unless the deceased is found more than 50% responsible.
