What the Law Says

Texas Transportation Code Section 552.003 requires the operator of a vehicle to stop and yield the right-of-way to a pedestrian crossing a roadway in a marked or unmarked crosswalk when no traffic signal is controlling the intersection. This duty exists because pedestrians are far more vulnerable to serious injury in a collision, and Texas law places the responsibility on drivers to watch for and yield to people on foot. When a driver fails to yield and a pedestrian is struck, that failure can support a negligence claim in a civil injury case, independent of any separate criminal investigation into what caused the driver to lose control.

Texas Transportation Code Section 550.021 requires the operator of any vehicle involved in a collision resulting in injury or death to immediately stop at the scene, or as close to it as possible, and determine whether anyone involved needs aid. Failing to stop and render aid after a crash that injures someone is a criminal offense in Texas and can also be relevant evidence in a civil case over who is responsible for the injuries. This duty applies regardless of what other circumstances, such as a shooting, may have preceded the collision.
