A 26-year-old man riding an e-bike was killed Saturday afternoon after being struck by a vehicle while crossing South Melrose Drive at Breeze Hill Road in Vista, California. The e-bike rider allegedly entered the intersection against a red traffic signal when he was hit by a car traveling northbound. He was rushed to a nearby hospital, where he later died from his injuries. The driver remained at the scene and cooperated with investigators, and officials say drugs and alcohol are not believed to have been a factor in the crash.

What the Law Says

California Vehicle Code 21453 requires drivers facing a steady red signal to stop at the marked limit line, or before entering the crosswalk or intersection, and to remain stopped until the signal changes. Under Vehicle Code 21200, this same duty applies to anyone riding a bicycle or e-bike on a public roadway, since cyclists are subject to the same rules as motor vehicle drivers. When a rider enters an intersection against a red light, as sheriff’s officials say happened in this crash, it can be a central factor in determining fault. Even so, drivers still have a duty to keep a lookout and avoid a collision when it can be done safely.

California Vehicle Code 21200 grants bicycle and e-bike riders the same rights, and imposes on them the same responsibilities, as drivers of motor vehicles, including obeying traffic signals and signs. This means an e-bike rider who crosses against a red light can be found partly or fully at fault for a resulting collision, just as a driver would be. At the same time, the law does not excuse a motorist from exercising reasonable care to avoid striking a cyclist already in the roadway. Fault in these crashes is often shared and depends on the specific facts investigators uncover.
