What the Law Says

Texas Transportation Code 545.157 requires drivers approaching a stopped emergency vehicle with lights activated to move over a lane when possible or slow down to a reasonable speed below the posted limit. The law exists to protect officers and responders working on the roadside. A driver who fails to follow it may face liability for resulting injuries.

Texas Transportation Code 545.351 requires drivers to operate at a speed that is reasonable and prudent under the circumstances, considering traffic, road conditions, and hazards. Approaching a crash scene at night or before dawn calls for extra caution. Whether a driver met this standard is typically a key question after a collision like this one.

This summary is general information, not legal advice. Every case depends on its specific facts.
