Man Killed in Vehicle Versus Pedestrian Crash In Banning
California Vehicle Code 20001 requires any driver involved in a crash that causes injury or death to immediately stop at the scene and provide identification and aid. Fleeing the scene, as allegedly happened in this Banning-area crash, is a separate crime from the collision itself and can carry felony penalties, including additional prison time when the crash caused death or serious injury. The law exists precisely to prevent victims from being left without help or a way to identify the responsible driver.
California Vehicle Code 21954 governs pedestrians walking along a highway outside a marked crosswalk, requiring them to yield the right-of-way to approaching vehicles. The statute makes clear, however, that this duty does not relieve a driver of the ongoing obligation to exercise due care for the safety of any pedestrian on the roadway. On a rural mountain highway like State Route 243, where lighting and shoulders can be limited, that duty of care becomes especially important.
