A 27-year-old father was killed and his 3-year-old daughter was injured on September 12, 2026, when a pickup truck crossed into oncoming traffic and struck their sedan head-on on FM 725 in New Braunfels, Texas. New Braunfels police say the truck’s driver, 25-year-old Rafael Alejandro Arreguin-Ramirez, showed signs of intoxication at the scene. His passenger, 23-year-old Alejandro Aguillen-Acosta, allegedly fled the crash and hid in a nearby yard before officers found him. Both men were arrested and now face charges of intoxication manslaughter, aggravated assault with a deadly weapon, and evading arrest.

According to KTSA, U.S. Immigration and Customs Enforcement lodged detainers against both men on September 13 while they were held at the Guadalupe County Jail, with the Department of Homeland Security saying both had allegedly entered the country illegally from Mexico. The outlet reported that the victim’s young daughter suffered non-life-threatening injuries and was taken to a hospital for treatment. The criminal case remains active alongside separate immigration proceedings against the two men.

What the Law Says

Under Texas Penal Code § 49.08, a person commits intoxication manslaughter when they operate a motor vehicle while intoxicated and, by accident or mistake, cause the death of another person. It is a second-degree felony, and prosecutors do not need to prove intent to harm – only that intoxication caused the fatal crash. This is the charge New Braunfels police filed against the truck’s driver after the head-on collision that killed a 27-year-old father.

Texas Transportation Code § 545.051 requires drivers to stay on the right half of the roadway except when passing, turning left, or avoiding an obstruction. Crossing the center line into an oncoming lane, as police allege happened in this crash, is a basic rules-of-the-road violation that frequently supports both criminal charges and civil liability in head-on collision cases.
