A Tyler, Texas police officer was critically injured on the night of Friday, September 18, 2026, when a driver authorities say was intoxicated ran a stop sign at high speed and slammed into his marked patrol car. Officer Josiah Baxter had to be cut out of the wreckage and was rushed to a hospital, where doctors found he had suffered a broken hip, a broken arm, a spinal fracture, broken ribs and a broken clavicle. On Friday, September 25, fellow officers gathered at the hospital to send Baxter off with a police escort as he was transferred to a rehabilitation facility to continue his recovery. The Tyler Police Department and community groups have rallied around Baxter and his family in the days since the crash.

KLTV reported that Baxter, who is the sole provider for his wife and three children, one of whom requires round-the-clock care, has received support from the Tyler Police Foundation, the Tyler Patrolman’s Association and local restaurants donating proceeds toward his recovery. The crash remains under investigation by Tyler police as Baxter begins the next phase of his treatment.

What the Law Says

Texas Penal Code § 49.07 makes it a crime to operate a vehicle while intoxicated and cause serious bodily injury to another person, an offense known as intoxication assault. When the victim is a peace officer acting in the line of duty, as authorities allege happened here, the offense is enhanced to a second-degree felony carrying up to 20 years in prison. This statute allows an injured officer’s family to pursue both criminal accountability and a separate civil claim for injuries and losses.

Texas Transportation Code § 544.010 requires drivers to come to a complete stop at a posted stop sign and yield the right-of-way before entering an intersection. Authorities say the driver who struck Officer Baxter’s patrol car ran a stop sign at a high rate of speed, a violation of this statute that can serve as evidence of negligence in a civil injury claim. Failing to stop at a controlled intersection is one of the most common causes of T-bone and cross-traffic collisions on Texas roads.
