A Washington State Patrol trooper was injured late Saturday, Sept. 19, 2026, after being struck while investigating a crash on southbound SR-3 near the Sherman Heights area outside Bremerton, in Kitsap County. Around 10:37 p.m., a 29-year-old man allegedly drove off the highway shoulder and into a ditch; while the responding trooper’s patrol car was stopped at the scene, another vehicle came around a bend in the highway and rear-ended it. The trooper reported neck pain and was treated for minor injuries. The passenger in the initial crash, a 30-year-old Port Orchard woman, was transported to Tacoma General Hospital. The right lane of southbound SR-3 was closed while troopers investigated.

According to the Kitsap Sun, the 29-year-old driver of the initial crash faces potential DUI and vehicular assault charges, though prosecutors had not formally filed charges as of the outlet’s report while the Washington State Patrol investigation continued. The outlet reported the passenger was not wearing a seatbelt at the time of the crash. KING 5 separately reported that a trooper was struck by a vehicle while investigating a crash in Kitsap County around the same time, corroborating the incident. No further updates on the trooper’s condition or formal charges had been released as of publication.

What the Law Says

Washington’s ‘move over’ law, RCW 46.61.527, requires drivers approaching a stationary emergency vehicle with its lights activated to move into a non-adjacent lane if possible, or otherwise slow down and pass with caution. The law exists to protect troopers, tow operators and other responders working roadside after a crash, exactly the situation involved when a patrol car was struck along SR-3. Failing to yield or slow for a stationary emergency vehicle is a traffic infraction that can support a negligence claim if it causes an injury.

RCW 46.61.522 makes it a felony to operate a vehicle recklessly, while under the influence, or with disregard for the safety of others in a way that causes substantial bodily harm to another person. Prosecutors can pursue vehicular assault charges when a driver’s impairment or recklessness is allegedly tied to a crash that injures someone, as authorities are investigating in this case. A vehicular assault charge is separate from, and can proceed alongside, a civil injury claim brought by anyone hurt in the underlying collision.
