Houston Police are investigating whether intoxication was a factor, in addition to speed

A driver died early Sunday morning after losing control of a Porsche coupe on the South Loop feeder road in southwest Houston. The crash happened around 1:12 a.m. as the vehicle exited Interstate 610 near Kirby Drive and continued at a high rate of speed along the access road. The car struck a curb, went airborne, and slammed into a utility pole in front of Pappasito’s Cantina. The driver, who appeared to be alone in the vehicle, was pronounced dead at the scene, and the crash knocked down power lines that forced a temporary closure of the freeway.

According to Click2Houston, Houston Police say speed was a contributing factor, and investigators are still working to determine whether intoxication played a role in the crash. The outlet reported that the driver had not been publicly identified as of early Sunday morning. Fox 26 Houston additionally reported that I-610 was temporarily shut down after the collision brought down power lines across the freeway, though the lines reportedly did not disrupt electrical service in the area. The scene has since been cleared, but the investigation into what caused the driver to lose control remains active.

What the Law Says

Texas law requires drivers to operate at a speed that is reasonable and prudent under existing conditions, and never faster than what is safe for the circumstances. Investigators believe the driver in this crash was traveling well above a safe speed on the South Loop feeder road when he lost control, struck a curb, and went airborne. Excessive speed reduces a driver’s ability to react and dramatically increases the severity of any resulting crash. A violation of this statute can serve as evidence of negligence in a resulting civil claim.

Texas Penal Code makes it a criminal offense to operate a vehicle while intoxicated by alcohol or drugs. Houston Police have not said whether intoxication contributed to this crash, but it remains part of the ongoing investigation. If toxicology results were to show impairment, that finding could support both criminal charges and a civil claim against the driver’s estate. Families affected by a driver who was allegedly intoxicated may have additional avenues for compensation beyond a standard negligence claim.
