The impact caused the mail truck to roll over, and the SUV was left hanging over the edge of the overpass near Grace Church. The driver of the SUV was ejected and pronounced dead at the scene. Other occupants of the SUV and the USPS driver reportedly suffered only minor injuries. Authorities say the SUV driver is suspected of having been intoxicated at the time of the crash.

ABC13 Houston reported that part of the tollway was shut down overnight as crews cleared debris and repaired damaged guardrails. The Harris County Precinct 5 Constable’s Office confirmed it is investigating the crash, including the driver’s suspected intoxication. No charges have been announced as the investigation continues.

What the Law Says

Texas Penal Code Section 49.04 makes it a crime to operate a motor vehicle in a public place while intoxicated, whether from alcohol, drugs, or a combination of both. A first DWI offense is typically a Class B misdemeanor, but the charge escalates sharply when a crash causes serious injury or death. If investigators confirm the SUV driver in this crash was intoxicated, that finding could support both criminal charges and a civil claim against the driver’s estate or insurer.

Texas Transportation Code Section 545.062 requires drivers to maintain a safe following distance behind other vehicles, taking speed and road conditions into account. Rear-end collisions like this one, where a passenger vehicle struck the back of a much larger USPS 18-wheeler, are often evaluated under this standard to determine fault. A violation can support a negligence claim even where, as alleged here, intoxication is also a factor.

This summary is general information, not legal advice. Every case depends on its specific facts.
