What the Law Says

Washington’s rules of the road require every driver to operate at a speed that is reasonable and prudent given conditions and hazards, including the presence of other road users. A driver who fails to use reasonable care around people on scooters or other small vehicles may be found negligent. Whether that happened here depends on the facts the investigation establishes.

Washington follows a pure comparative fault system under RCW 4.22, so an injured person’s recovery is reduced by their share of fault rather than barred. A young child’s conduct is judged by what is reasonable for a child of that age. Families with questions can seek a free consultation; there is no fee unless we win.
