What the Law Says

Texas Transportation Code Chapter 552 sets out pedestrian rights and driver duties. Section 552.008 requires drivers to exercise due care to avoid colliding with a pedestrian on a roadway and to take proper precautions when they see a child. Whether a driver met that duty depends on the facts of the crash.

Texas Civil Practice and Remedies Code Chapter 33 governs proportionate responsibility. Under it, a claimant’s recovery can be reduced by their percentage of responsibility and is barred if it is greater than 50 percent. Fault is decided case by case once the facts are known.

This summary is general information, not legal advice. Every case depends on its specific facts.
