What the Law Says

California Code of Civil Procedure § 377.60 allows certain surviving family members — such as a spouse, domestic partner, or children — to bring a wrongful death claim when a person is killed as the result of another party’s wrongful act or negligence.

Everyone is responsible for injuries caused to others by their want of ordinary care or skill. In collisions between motorcycles and other vehicles, the family of a rider who is killed may pursue compensation from any party whose negligence contributed to the crash.
